I haven't seen this mentioned by Shayne, nor by anyone offering FDK, but I think that it should be.
From Clark's standpoint, a couple of nations (i.e. our USA and France) have committed an act of war against his USA, by using their technology (inadvertently or not) to divert one of its civilian aircraft together with 195 passengers and crew, forcing them to land at gunpoint, and then holding them captive and depriving them of their civil rights as well as dismantling this multi-million-dollar aircraft.
He ought to be able to make a good case before the United Nations (as well as the court of public opinion) based on these facts alone, if they can be proved.
